Massachusetts is one of the states with friendly and thriving gambling industry. In-person betting is allowed in the state, including casinos, lottery, parimutuel wagering on horse races, and charitable gaming. The Massachusetts Gaming Commission regulates these casinos’ in-person and commercial operations. There are currently three casino facilities in the state Everett, Springfield, and Plainville. According to the American Gaming Commission, the regulated gambling industry is worth $1.02 billion as of 2021. However, Massachusetts does not authorize or license any online casinos, poker sites, or sports betting sites.

Updated Legal Status of Gambling in Massachusetts

The state’s gaming and gambling crimes regulations are covered by MGL c.137 and MGL c.271, respectively. Its official regulator, the Massachusetts Gaming Commission, operates under the rules set by MGL c.23K. Under this law, the state will only permit up to three casinos and one slots-only casino. In addition, the state’s gaming laws have a few provisions covering Indian tribes.

In addition to in-person wagering in casinos, sports gambling is now allowed in the state. Last August 2022, Governor Charlie Baker signed the bill to officially legalize sports betting by formally joining several US states that allow betting on sports. First proposed in 2019, the bill came years after the Supreme Court struck down the federal ban in 2018. With the sports betting law in effect, Massachusetts becomes the 36th state to legalize sports betting. However, the state’s sports betting law slightly differs from the laws in other states.

Under Massachusetts’ sports betting law, only bettors at least 21 can bet on sports. It’s in line with Connecticut but stricter than Rhode Island, which allows players at age 18. Interested players can wager on professional and collegiate sports, including eSports. Here’s one more crucial rule: players can’t bet on an in-state team unless it’s playing in the tournament.

There’s no timeline yet as to when legal sports betting will start. The Commission is currently processing the sports betting licenses and drafting specific industry rules and regulations. Our team will update this page as soon as new information about this comes to light.

Legality of Crypto Gambling in Massachusetts

In addition to sports betting, Bitcoin and crypto use also helps drive gambling’s popularity in the state. Bitcoin and the blockchain improve the bettors’ gambling experience as it offers fast, relatively cheaper and private transactions. Cryptos run on a decentralized blockchain where no single party or individual has complete control over the processes. As a result, transactions are faster and publicly recorded, giving every participant equal access to track transactions. Also, payments are primarily anonymous since most crypto casinos only require the crypto wallet address. The only time the individual needs to share personal and banking information is when he decides to buy Bitcoin on a trading platform or cryptocurrency exchange.

It also helps that there’s a friendly environment for Bitcoin and the blockchain in Massachusetts. A multi-stakeholder initiative includes the Boston Blockchain Association (BBA) and the Chamber of Digital Commerce, pushing for favorable state crypto regulations.

While the state is warming up to crypto use, Bitcoin gambling remains unregulated. There are no laws that license or regulate online casinos, and only the existing gaming rules apply. Since crypto gambling is still in the ‘grey area’, players who wish to gamble with Bitcoin can check offshore licensed casinos. But interested players must always proceed with caution due to regulatory and consumer protection issues.
